CAL NOVEL
OF 16/04/2023.
§ 1. GENERAL PROVISIONS
1. The organizer of the CAL Novela event on Facebook (hereinafter referred to as "CAL Novela") is Yaga Yaga Handmade Joanna Sitkiewicz, with its registered office at ul. Broniewskiego 3, 42-520 Dąbrowa Górnicza. NIP 629 223 43 10
(hereinafter referred to as the "Organiser").
2. The founder of the prizes in CAL Novela is the Organizer and the stores participating in CAL Novela.
3. The administrator of personal data provided by the Competition Participants is the Organizer.
4. Providing personal data is optional, but necessary for the Participant to join CAL Novela. Persons providing data have the right to access such data, change or delete them.
5. These regulations define the conditions of CAL Novela.
6. CAL Novela is not created, administered, supported or sponsored by Facebook.
Facebook is a registered trademark of Facebook, Inc.
7. CAL Novela is run in the CAL Novela group, which is administered by the website
www.facebook.com/yagayagahandmade (hereinafter referred to as "Fanpage").
8. The Organizer supervises the correctness and course of the Competition, i.e. providing information about the Competition and considering complaints.
§ 2. CAL Novela PARTICIPANTS
1. Only natural persons, consumers within the meaning of Art. 221 of the Civil Code, having full legal capacity, being users and having an active account on Facebook.com; that have accepted these Regulations (hereinafter: "Participant").
2. The Participant declares that:
a. Is a natural person with full legal capacity;
b. He has read the content of these Regulations and voluntarily joins CAL Novela;
c. Consents and accepts the terms of the Regulations, including read the content regarding the prize collection procedure and fully accepts it;
d. I undertake to comply with the provisions of the Regulations, including the Facebook regulations;
e. Consented to the processing of personal data for purposes related to participation in CAL Novela;
f. Is a registered User of the Facebook social network;
3. Employees and associates of the Organizer may not participate in the Competitions organized during CAL Novela.
4. The participant agrees to the publishing by the organizer of photos of competition scarves on Facebook and Instagram.
5. Participation in the Final Competition is voluntary.
§ 3. PLACE, TIME AND CAL Novela RULES
1. CAL Novela is an event organized in a closed group on the Facebook social network in the CAL Novela group, managed by the Organizer at
https://www.facebook.com/groups/711776537363186
2. CAL Novela lasts from 05/05/2023 at 00:01 to 25/06/2023 hours 23:59.
§ 4. RULES OF PARTICIPATION IN CAL Novela
1. The condition for participation in CAL Novela is:
a. Having an active account on the Facebook social network.
b. Payment of the fee for participation in CAL Novela in the amount of PLN 20 gross via the online store www.yagayaga.pl or to the bank account: PL 16 1050 1272 1000 0097 5330 1119 or BLIK: 513 340 684 or PayPal: asiasitkiewicz@interia.pl
c. The participant sends a request to join the CAL Novela group at
https://www.facebook.com/groups/711776537363186
by entering in the empty field the answer with the password provided by the Organizer (provided in a private message after the Participant has made the payment) or by entering the reference number received in the www.yagayaga.pl store after purchasing the 'ticket'.
d. The participant accepts the rules of the CAL Novela group.
e. The Participant waits for the Organizer's approval to join the CAL Novela group no longer than 12 hours from the moment of sending the request for participation.
2. The pattern for the Novela shawl will be made available in parts according to the following schedule:
1. part 1 - May 05
2. part 2 - May 10
3rd part 3 - May 17
4. part 4 - May 24
5. part 5 - May 31
6.part 6 - June 07
7. part 7 (end) - June 14
8. The end of CAL Novela with the final competition - June 25, 2023
3. The participant does not bear any consequences for not making the scarf during the CAL Novela.
4. The Participant has the right to use the designs also after the end of the CAL Novela, complying with the copyrights belonging to the Organiser.
c) Take actions using third party accounts/profiles that do not comply with the Facebook rules; d) Interfere with the mechanism of operation of the Competition;
e) They create fictitious Facebook accounts/profiles
4. The Organizer is not responsible for any disruptions in the operation of ICT connections, servers, interfaces, browsers and the Facebook platform.
5. The Organizer is not responsible for temporary or permanent blocking of the page or application by Facebook.
§ 8. PROCESSING OF PERSONAL DATA
1. Personal data of CAL Novela Participants will be processed by the Organizer only for the purpose of performing activities necessary for the proper conduct of CAL Novela.
2. The personal data of the CAL Novela Participants will be stored by the Organizer only for the period necessary to conduct the CAL Novela and to issue prizes to the distinguished Participants.
3. Participants have the right to inspect the processed data and correct and delete them.
The data is provided on a voluntary basis, however, in order to participate in CAL Novela, registration on the Facebook social networking site is required.
4. At the moment of deleting the data, the User loses the possibility to Participate in CAL Novela.
§ 9. COPYRIGHT
1. All intellectual property rights to CAL Novela are vested in the Organizer.
Participation in CAL Novela does not result in the acquisition of any intellectual property rights by Participants. It is forbidden to infringe intellectual property rights in CAL Novela in any way, in particular:
a) Copying, modifying and transmitting electronically or
otherwise disseminating the CAL Novela mechanism or its parts, as well as individual designs and photos covered by copyright and databases, without the express written consent of the Administrator;
b) Using CAL Novela in a manner inconsistent with the Regulations or generally applicable regulations.
§ 10. COMPLAINTS AND NOTIFICATIONS OF INFRINGEMENTS
1. Any complaints regarding the manner of conducting the CAL Novela should be submitted by the Participants in writing during the CAL Novela, but not later than within 14 (fourteen) days from the end of the CAL Novela.
2. A complaint filed after the deadline has no legal effect.
3. A written complaint should contain the name, surname, exact address of the Participant and a detailed description and justification of the complaint.
4. The complaint should be sent by registered mail to the Organiser's address.
5. Complaints will be considered in writing within 30 days.
§ 11. FINAL PROVISIONS
1. The Regulations come into force on April 16, 2023 and are valid until June 25, 2023.
2. In matters not covered by these Regulations, the provisions of the Civil Code and other legal provisions shall apply.
3. Disputes relating to and arising from CAL Novela will be resolved by a common court competent for the seat of the Organizer.
